BREEDING CONTRACT

This contract is for the breeding _____________ to the stallion____________________

The fee for this service is________________ . The amount________________ of shall be paid at the signing of the contract.

The balance shall be due and owing once the mare is certified in foal by a certified veterinarian.

The stallion owner agrees:

To provide blood typing and registration of the stallion accordance with PFHA rules.

2. To provide all pertinent documentation for the registration of the resulting offspring.

3. To guarantee that all-resulting foals from these breedings will pass the stallion side of the parental verification test.

4. To guarantee a Live Foal.

5. See to it that semen is shipped for use in a timely manner.

The mare owner/agent agrees:

1. To present the mare in good health and in clean and sound breeding condition.

2. To pay all transportation charges of semen within USA, and all veterinary expenses associated with the semen collection.

3. To return any and all shipping containers as soon as the semen has been used.

4. To insure shipping container for its full replacement cost or be responsible for its full replacement cost if not insured.

5. Agrees to palpate the mare so that her heat cycle may be anticipated, and to advise the stallion owner of probable ovulation date in time for the semen collection and transpiration.

Stallion owner may at any time request negative culture test and/or test (at mare’s owner’s expense) to verify the breeding condition of the mare. If however, after three successive breeding cycles, said mare cannot be certified in foal by a licensed Veterinarian, the stallion owner shall reserve the right to withdraw from this agreement and shall be granted release from further obligation. Should the stallion die or become unfit for service before the first shipment of semen for said mare, all money shall be returned to the mare owner.

I understand that the mare owner shall assume all responsibility for the condition of the mare and shall bear all risk of loss or damage to the mare whether by death, disease, injury, infection or otherwise, and by any cause whatsoever, and therefore agrees to hold

Or any person employed by or associated with harmless for any damages associated therewith.

Payment of cost and attorneys’ fees. The mare owner shall also pay forthwith all cost, charges, expenses and disbursements of the stallion owner/agent, including all attorneys’ fees incurred in securing payment of such breeding(s), or any part of the same, or in any proceeding action concerning same, or looking toward the protection for the stallion owner/agent rights or collection of the money owed or any part thereof.
